  1. Consent Scope, Timing & Duration (One-Time Electronic Consent)

Your account was created by your clinic. By selecting “Agree & Begin Assessment” below, you provide a one-time electronic consent to this Waiver, Consent & Privacy Disclosure. This consent applies to your clinic-managed account and all future BalancePro™ assessments until you withdraw it or we present updated terms that require renewed consent.

You can withdraw consent at any time by notifying your clinic or emailing hello@kinis.com. Some features (including assessments) will stop working if you withdraw. Withdrawal does not affect processing already performed lawfully; we will delete or de-identify data not required for ongoing services or legal obligations.

Record of Consent: We store your name, date/time, device/IP, user agent, consent version, and a secure hash of this document. To view or export your consent record, contact your clinic or hello@kinis.com.


  1. Purpose & What You’ll Do

BalancePro™ is a short movement assessment that estimates balance and functional mobility. It uses your device’s camera to analyze your movement (computer-vision joint tracking) while you perform simple tasks (e.g., feet together, single-leg stance, five-times sit-to-stand). It takes ~5 minutes and produces scores/metrics your clinician can review with you.

  1. Care Setting, Eligibility & Safety

This test is performed under the supervision of your clinician in a clinic setting.

  • You confirm you are 18+ (or have documented parent/guardian consent where permitted).

  • The test should be performed in a clear, well-lit area with a stable, armless chair (≈43–46 cm/17–18 in seat height). A spotter and gait belt are recommended if needed.

  • Stop immediately if you feel pain, dizziness, lightheadedness, shortness of breath, chest pain, or instability, and inform your clinician.

Do not take this test if your clinician has advised against balance testing (e.g., recent surgery, acute injury, uncontrolled dizziness, high fall risk).

  1. Not Medical Care / No Emergency Use

Kinis.ai, Inc. is not a healthcare provider; BalancePro™ is not a diagnosis or treatment. Results are for informational use only. In an emergency, call local emergency services. Your clinician is responsible for medical judgment and any care plan.

  1. Clinical Alignment (No Certification/Approval Claim)

BalancePro™ tasks are aligned with widely used clinical protocols (e.g., Single-Leg Stance, Five-Times Sit-to-Stand). This does not mean the tool is a medical device or certified/approved for diagnosis or treatment.

  1. Risks You Acknowledge

Movement testing involves inherent risks including loss of balance, falls, strains, or other injury. You accept these risks and agree to follow all safety instructions given by your clinician.

  1. Voluntary Participation & Choices

Participation is voluntary. You may refuse or stop at any time without penalty or loss of other care. Some features may be unavailable if you decline specific permissions (e.g., camera access).

  1. Video & Sensor Data Consent

You authorize Kinis.ai to capture and process video frames and sensor data from the clinic device only to:

(i) run the assessment; (ii) generate your results; (iii) ensure safety and performance; and (iv) improve model accuracy and product features as described in §8.

Because you are using Kinis.ai through a clinic, your provider may view your results as part of your care.

  1. Privacy, Data Use & Retention (Summary)

  • Data collected: Clinic-created account info; device/app logs; assessment video frames or derived keypoints; scores/metrics; feedback/support messages.

  • Uses: To deliver the service; maintain safety; improve models/features; quality assurance; security/fraud prevention; and—with separate permission—research (§9).

  • Sharing: With service providers (cloud, analytics, support) under contract; with your clinic for your care; with research partners only if data are de-identified or you have given separate research consent.

  • HIPAA / VCDPA:

    • Because you are using Kinis.ai through a healthcare provider, some data may be protected health information (PHI) under HIPAA and handled under agreements with your clinic.

    • If you later use Kinis.ai independently, HIPAA may not apply; Kinis.ai complies with the Virginia Consumer Data Protection Act (VCDPA) and other applicable laws.

  • Retention: Personal data is kept as long as needed for these purposes and legal obligations, then deleted or de-identified.

  • Your rights: You may request access, correction, deletion, portability, or limits on certain uses by contacting your clinic or hello@kinis.com.

  1. Research (Separate Consent)

You may be invited to allow your data to be used in IRB-governed research. Research is optional and requires a separate, project-specific consent.

  1. License to Use De-Identified Data

You grant Kinis.ai a non-exclusive, worldwide license to use de-identified data for model training, analytics, and product improvement. De-identified data will not reasonably identify you.

  1. Assumption of Risk; Release & Waiver (Kinis.ai Only)

To the fullest extent permitted by law, you assume all risks from using the platform and participating in BalancePro™ and release and hold harmless Kinis.ai, Inc. and its officers, employees, and agents from claims related to injury or damages from ordinary negligence by Kinis.ai. This release does not waive claims of gross negligence, willful misconduct, or rights that cannot be waived under law.


This applies to Kinis.ai only and does not affect any rights you may have with your clinic.

  1. Indemnification

You agree (as permitted by law) to indemnify Kinis.ai from third-party claims arising from your misuse of the platform or violation of these terms.

  1. No Warranties; Limitation of Liability

The platform is provided “as is.” Kinis.ai does not guarantee uninterrupted or error-free operation or that results are clinically accurate for every user or use case. Where permitted, Kinis.ai’s total liability will not exceed the amounts paid to Kinis.ai (if any) in the 12 months before the claim.

  1. Communications & E-Signature

You agree to provide this consent electronically by selecting “Agree & Begin Assessment.” You consent to receive notices electronically (email, in-app, or SMS). You may withdraw consent at any time by contacting your clinic or hello@kinis.com (some features may stop working).

  1. Children, Guardians & Interpreters

Kinis.ai is not directed to children under 13. Users 13–17 may participate only with documented parent/guardian consent. If you require an interpreter, inform your clinician; their name will be logged.

  1. Governing Law & Venue

These terms are governed by the laws of Delaware, without regard to conflict-of-law rules. Exclusive venue lies in the state or federal courts located in New Castle County, Delaware (e.g. Wilmington).

  1. Updates; Severability; Entire Agreement

We may update this document. You will only be asked to re-consent if there are material changes. If any part is found invalid, the rest remains in effect. This, our Privacy Notice, and Terms of Use are the entire agreement on these topics.

By selecting “Agree & Begin Assessment,” you confirm that you:

  • Have read (or had read to you) this document

  • Had the opportunity to ask questions

  • Understand the risks and voluntary nature of participation

  • Agree to proceed with the BalancePro™ assessment
